Atty. Trixie Angeles, ipinaliwanag kung bakit pinalaya si Mark Anthony Fernandez



The acquittal of actor Mark Anthony Fernandez, who was arrested in October 2016 for possession of ₱15,000 worth of marijuana at a checkpoint in Angeles City, last December 22 (Friday) surprised PDEA Director General Aaron Aquino despite of his violation on the Republic Act of 9165 or the Comprehensive Dangerous Drug Acts of 2002.

“Fernandez was apprehended during his time as regional director of the Philippine National Police Region 3 branch” Aquino said.

“I would still respect the rule of law and the course of action of the PNP against Fernandez” Aquino added.

According to Judge Ireneo Pangilinan Jr. of the Angeles City Regional Trial Court Branch 58, Fernandez was acquitted because the Angeles cops committed procedural breaches in handling evidences or chain of evidence against Fernandez, though he was positive on the drug test for Marijuana use. In his defense, he’s been using it since 2008 after he was diagnosed with cancer.

To better understand the decision of San Fernando Regional Trial Court, the Facebook page Luminous by Trixie Cruz-Angelea, managed by Attorney Rose-Beatrix Cruz-Angeles, posted an explanation "chain of evidence/chain of custody/chain of custody of evidence.

According to the post, the breach of the chain of evidence occurs when a police failed to immediately submit the recovered evidence from the suspect to the court for a real-time documentation.

If at any point that there is a discontinuity during the transfer, that means that the chain of evidence is breached. This is one of the common reasons why some drug cases are being dismissed.

"Ano ba ang "chain of evidence?" or "chain of custody?" or "chain of custody of evidence?"

"Ayon sa decision ni Judge Ireneo Pangilinan ng San Fernando Regional Trial Court, kaya hindi napatunayan ang sala ni Mark Anthony Fernandez "beyond reasonable doubt" ay dahil binali ng mga pulis ang chain of evidence.

"Kapag hinuli ang isang suspect at may nakuhang ebidensya, sa halimbawang ito, isang brick ng marijuana, kailangan iprisinta ito sa hukuman. Kaya, from the time makuha ito sa suspect, dino-document ang bawat transfer nito mula sa suspect, sa arresting officer, sa laboratory for testing, balik sa officer o lipat sa evidence custodian tapos dadalhin ito sa court kapag araw na ng pagprisinta. 

"If at any point sa mga transfer na iyon, may discontinuity, o may pagkakataon na walang may hawak ng ebidensya na iyon, bali na ang chain of evidence. Halimbawa, kung mula sa arresting officer, naibigay ito sa iba na hindi naman accountable officer or hindi pulis o kaya naiwan lang kung saan, sa desk sa istasyon o sa kotse, may duda na na iyon mismo ang ebidensya o droga na nahuli. At hindi mapapatunayan ang possession ng droga na ito kasi hindi na sigurado kung yun yung nakuha. At kung hindi sigurado may duda na rin kung droga nga ang nakuha.

"Ang ganitong pangyayari ang pinaka common na dahilan sa dismissal ng mga kaso sa droga. Kaya kung meron tayong pagbibintangan dito, yung mga pulis na nag break ng chain of custody.

"Pero hindi rin natin sinasabing deliberate ito. Nangyayari minsan na pagod na ang mga arresting officers at hindi na malinaw magisip lalo na kapag more than 24 hours na ang duty at operations. O kaya, wala pa yung custodian or di pa bukas yung lab. Maraming dahilan.

"Sa ngayon wala namang ebidensya na deliberate ang pagbali ng chain of custody, kaya wag muna paginitan ang pulis hangga't may determination na negligent sila.  O sinasadya. Sa ngayon, wala
